MUMBAI: The Mumbai sessions court has upheld the order of the Esplanade Magistrate court by dismissing an appeal against the producers of the film Airlift. The Akshay Kumar-starrer was released in 2016.

A complainant named Hanif Ibrahim Modak had approached the court stating that he, his Late father, and Captain VR Kekobad along with their associates in coordination with various governments and private individuals were directly responsible for overseeing the rescue operation of the many stranded Indian citizens from Kuwait to Dubai port during Iraqi invasion in the year 1990.

He further stated that Akshay Kumar and five other producers had released a movie Airlift on January 21, 2016, and the movie contains defamatory content by the accused persons against the complainant and his associates by way of direct imputation, with the object of earning profits and deliberately influencing the public opinion at the cost of their reputation and goodwill.

It was further stated that the accused have claimed that the movie is based on true events. It also has a tagline to that effect along with a statement of Akshay Kumar, two days prior to the release of the movie on a news channel that was viewed by many people. The director of the movie also has claimed for such research upon movie for a specific tenure.

Modak had sent legal notice to Airlift makers however the film producers denied the allegations made by the complainant and refused to tender any apology. However, the Esplanade court had failed to appreciate various orders of the high court and Supreme Court and that a reasoned order was not passed while rejecting the plea.

The judge further added Trial Court has in detail dealt with the factum of the complaint and has categorically on the grounds of maintainability itself the complaint was dismissed. "Thus in view of the said observation in the impugned judgment delivered by the Trial Court apparently cannot be said that it is not a reasoned order," said Judge Joglekar.
